Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of Harbor (the “Service”), operated by On Harbor, LLC (“Harbor,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

These Terms apply to all Users of the Service. “Users” include:

  • Parents — parents, legal guardians, or other authorized adults who create and manage Harbor accounts on behalf of children (“Account Holders”)
  • Child Creators — children who create Content through a Parent's account
  • Co-Managers — adults a Parent invites to help manage a Publication
  • Followers — people a Parent approves to view a Publication

A “Publication” is a private Harbor channel featuring Content by one or more Child Creators. “Content” means all text posts, audio recordings, images, and other material created or uploaded to the Service.

2. Eligibility

To create an account or accept these Terms, you must be at least 18 years of age, or the age of majority in your jurisdiction if higher. By creating an account, you represent and warrant that you meet this requirement.

Children do not create their own Harbor accounts. All access by children is arranged through and supervised by a Parent. By registering on behalf of a child, the Parent represents that they are that child's parent or legal guardian, or have the express written authorization of the child's parent or legal guardian to act on their behalf.

3. License to Use the Service

Subject to your compliance with these Terms, Harbor grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to scrape, copy, or systematically extract data from the Service; to sublicense or resell access to the Service; or to use the Service for any purpose not expressly permitted by these Terms.

4. Description of Service

Harbor is a private publishing platform through which children can create and share Content — including written posts, audio recordings, and images — with an audience selected and approved entirely by their Parent. Harbor is not a public platform. Content on Harbor is never indexed by search engines, never publicly discoverable, and accessible only to people a Parent has approved.

The Service includes:

  • Private Publications managed by a Parent on behalf of one or more Child Creators
  • Parent review and approval of Content before it is published
  • Invite-only Follower access, with Parent approval for each Follower
  • Comment and reaction features, subject to Parent moderation
  • Audio recording and playback
  • Optional AI-powered writing assistance for Child Creators, controlled by the Parent
  • Optional AI image generation for post headers

5. Accounts and Registration

To use Harbor as a Parent, Co-Manager, or Follower, you must create an account. You agree to:

  • Provide accurate, complete, and current information when registering
  • Keep your login credentials confidential and not share them with others
  • Notify us promptly at hello@onharbor.app if you become aware of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

You may not create an account for another person without their knowledge, impersonate any person or entity, or provide false identity information. Harbor reserves the right to refuse registration or cancel accounts at its discretion.

6. Parent Responsibilities

Parents are the Account Holders and bear primary responsibility for all use of Harbor within their account. By creating a Publication on behalf of a child, you agree to:

  • Confirm that you are the child's parent or legal guardian, or that you hold express written authorization from the child's parent or legal guardian to act on their behalf
  • Supervise your child's use of the Service and all Content they create
  • Review and approve (or reject) all Content before it is published
  • Carefully manage who is granted Follower and Co-Manager access to your child's Publication, including promptly revoking access from anyone who violates these Terms
  • Moderate comments and reactions on your child's Content
  • Ensure that your child's use of the Service complies with these Terms

Before any child data is collected, we will send you a direct notice email explaining what information we collect and how it is used. You must click the consent link in that email to provide the verifiable parental consent required under the Children's Online Privacy Protection Act (COPPA). We will then send a confirmation email after a reasonable delay, which includes instructions on how to revoke your consent. 7. Co-Managers

Parents may invite other adults to serve as Co-Managers of a Publication. Co-Managers may assist with content moderation, Follower management, and other administrative functions as permitted by the Parent. Co-Managers must be at least 18 years of age, must comply with these Terms in full, and have no independent authority over the Publication beyond what the Parent has granted. Co-Manager access may be revoked by the Parent at any time. The Parent remains solely responsible for the actions of Co-Managers under their account.

8. Content

Ownership

You — or, in the case of a Child Creator, the Parent acting on the child's behalf — retain all ownership rights in the original Content you create and post to the Service. These Terms do not transfer any intellectual property ownership to Harbor.

License to Harbor

By posting Content to the Service, you grant Harbor a limited, non-exclusive, royalty-free license to store, reproduce, display, and distribute that Content solely as necessary to operate and provide the Service to your approved audience. This license is strictly limited to the operation of the Service. It does not permit Harbor to use your Content for advertising, to train AI models, or to distribute it outside of your approved audience. This license terminates when you delete the Content or close your account, subject to the retention periods described in our Privacy Policy.

AI-assisted Content

When a Child Creator uses the AI writing assistant, the Service stores the child's original text and any AI suggestions separately. The child's original work is always preserved and distinctly attributed. Content that includes AI-generated elements is subject to the same ownership and license terms above. You are responsible for reviewing all AI-generated or AI-suggested Content before publishing it.

Prohibited Content

You agree not to post, publish, or allow Content that:

  • Is unlawful, threatening, abusive, harassing, or defamatory
  • Sexualizes, exploits, or endangers any child in any way
  • Infringes on any third party's copyright, trademark, or other intellectual property right
  • Discloses private information about another person without their consent
  • Contains viruses, malicious code, or links to harmful material
  • Constitutes spam, commercial solicitation, or unsolicited bulk communication
  • Misrepresents the identity of any person or entity

Harbor reserves the right to remove Content that violates these Terms or is otherwise harmful, at our sole discretion and without prior notice.

9. Acceptable Use

In addition to the Content restrictions above, you agree not to:

  • Attempt to gain unauthorized access to any part of the Service, another User's account, or Harbor's systems or networks
  • Probe, scan, or test the vulnerability of any Harbor system or network, or circumvent any security or authentication measure
  • Use automated means (bots, scrapers, crawlers) to access or collect data from the Service
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
  • Use the Service for any commercial purpose, including to advertise or solicit other Users
  • Attempt to reverse-engineer, decompile, or otherwise derive source code from the Service

10. AI-Powered Features

Writing Assistant

The AI writing assistant is an optional feature available to Child Creators at their Parent's discretion. Assistance is tiered by the child's age and subject to the Parent's settings. The assistant is intended to help children improve their own writing, not to write Content on their behalf. When the assistant is used, the child's original text and the AI suggestion are preserved separately; the child's original work is always attributable.

AI Image Generation

Parents may optionally generate AI images to use as header art for a child's posts, based on a parent-provided prompt or the post title.

Your responsibility for AI output

Harbor does not guarantee the accuracy, appropriateness, or originality of any AI-generated output. You are responsible for reviewing AI suggestions and generated images before publishing. All AI-generated Content is subject to the Prohibited Content rules in Section 8. Harbor is not liable for any claims arising from AI-generated Content that you choose to publish.

11. Third-Party Content and Links

The Service may allow Users to embed or link to content hosted by third parties (for example, YouTube videos). Harbor does not control third-party content and is not responsible for its accuracy, legality, or appropriateness. Links or embeds do not constitute endorsement by Harbor. Your interactions with third-party services are governed by those services' own terms and privacy policies. Parents should review any third-party content embedded in posts before approving them for publication.

12. Follower Access and Conduct

Followers are granted access to a Publication at the Parent's invitation and may have that access revoked by the Parent at any time for any reason. By accessing a Publication as a Follower, you agree to:

  • Treat all Content with respect, recognizing that it is created by children and shared in a private, trusted setting
  • Not capture, reproduce, download, screenshot, screen-record, or redistribute Content from any Harbor Publication without the explicit written permission of the Parent
  • Not attempt to contact any Child Creator directly or through any other platform, application, or means outside of Harbor
  • Not share your Follower access, invitation links, or access codes with anyone who has not been approved by the Parent
  • Comply with all comment moderation decisions made by the Parent or Co-Managers
  • Not post comments that are inappropriate, sexual, harassing, threatening, or otherwise harmful to children

Violation of these conduct rules is grounds for immediate removal from the Publication and termination of your Harbor account.

13. Copyright Infringement (DMCA)

Harbor respects intellectual property rights. If you believe that Content on the Service infringes your copyright, you may submit a notice to our designated copyright agent at hello@onharbor.app with the subject line “DMCA Notice.” Your notice must include: (1) a description of the copyrighted work you claim has been infringed; (2) a description of where the infringing material appears on the Service; (3) your contact information; (4) a statement that you have a good faith belief the use is not authorized; (5) a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and (6) your physical or electronic signature.

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the allegedly infringing Content. We will also notify the User who posted the Content, who may submit a counter-notice if they believe the removal was in error.

We reserve the right to terminate the accounts of Users who are repeat infringers.

14. Privacy and Children's Data

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, and protect personal information — including the personal information of Child Creators — and describes your rights with respect to that information. By using the Service, you agree to the data practices described in our Privacy Policy.

15. Fees

Harbor is currently free to use. We may introduce paid features or subscription tiers in the future. If we do, we will provide advance notice before any fees apply to your account, and your continued use of any paid feature will constitute your agreement to the applicable pricing terms.

16. Service Modifications and Availability

We may modify, suspend, or discontinue the Service or any part of it at any time. We will make reasonable efforts to provide advance notice of material changes. Harbor is not liable for any disruption, loss, or inconvenience that results from modifications to or unavailability of the Service.

17. Suspension and Termination

By you

You may close your account at any time by contacting us at hello@onharbor.app. Upon account closure, we will delete your data as described in our Privacy Policy. We encourage you to export any Content you wish to keep before closing your account; we will provide Content in a downloadable format upon request.

By Harbor

We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms, engaged in conduct harmful to other Users (including children), or for any other reason at our sole discretion. Your right to use the Service ends immediately upon termination. For terminations not related to a violation, we will make reasonable efforts to give you an opportunity to export your Content before deletion.

18. Disclaimers

YOUR USE OF THE SERVICE, ITS CONTENT, AND ANY FEATURES OR ITEMS OBTAINED THROUGH THE SERVICE IS AT YOUR OWN RISK.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE AT ALL TIMES. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, SAFETY, OR APPROPRIATENESS OF ANY CONTENT OR AI-GENERATED OUTPUT, AND WE MAKE NO GUARANTEE THAT THE SERVICE WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

19. Limitation of Liability

IN NO EVENT WILL HARBOR, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, AND LOSS OF DATA, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE AND EVEN IF HARBOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARBOR'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID HARBOR IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply only to the extent permitted by law.

20. Indemnification

You agree to indemnify, defend, and hold harmless Harbor and its affiliated companies, contractors, licensors, service providers, employees, agents, officers, and directors from and against any and all claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) any Content you post to the Service; or (d) your violation of any third party's rights.

21. International Users

Harbor is operated from the United States of America. If you choose to access the Service from outside of the United States, you are responsible for compliance with applicable local laws.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York without giving effect to any principles of conflict of law.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved through good-faith negotiation will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except that either party may bring claims in small claims court if the dispute qualifies. Before initiating arbitration, the party seeking relief must provide written notice to the other party describing the claim in reasonable detail and allow 30 days for good-faith resolution. Arbitration will be conducted in New York County, New York, or, at your election, by telephone or video conference.

YOU AND HARBOR EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

23. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify Account Holders by email with reasonable advance notice before changes take effect. Your continued use of the Service after updated Terms take effect constitutes your acceptance of those Terms. If you do not agree to updated Terms, you should stop using the Service and close your account.

24. General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Harbor regarding your use of the Service and supersede any prior agreements or understandings on that subject.
  • Severability; Waiver. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in full force and effect. No waiver of any term of these Terms will be deemed a further or continuing waiver of that term or any other term. Harbor's failure to assert any right or provision will not constitute a waiver. Any waiver must be in writing and signed by an authorized representative of Harbor.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Harbor may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets, with notice to you.
  • Force majeure. Harbor will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
  • Notices. We will deliver notices to you via email to the address associated with your account or by posting a notice on the Service. Notices to Harbor should be sent to hello@onharbor.app.
